Japan National Tourism Organization Singapore Office (hereafter referred to as “Organizer”) invites you (hereafter referred to as “you” or “Participant”) to take part in the JAPAN by Japan’s Game, “Japan 47 Prefectures Game!” (hereafter referred to as “Game”) of the “Marvellous Food Adventure in Japan” campaign (hereafter referred to as “Campaign”).

The Organizer reserves the right to cancel or amend the Campaign and the terms and conditions of this Campaign (“Terms and Conditions”) at any time without prior notice. Any changes will be posted on the website. By participating in and continuing to participate in the Game, you agree to these Terms and Conditions as may be amended from time to time.

Terms and Conditions

Eligibility

• Only Participants who meet the following eligibility criteria can participate in the Game (“Eligibility Criteria”):
  • Participants must be individuals who are residents of Singapore;
  • Participants must be at least 21 years old;
  • Participants must not be employees or immediate families of the Organizer, its affiliates, subsidiaries, suppliers, or of the advertising and media agencies associated with this Campaign; and
  • Participants must not be corporations or other legal entities.
• The Organizer may from time to time amend or add to the Eligibility Criteria.
• Any Participant who does not meet the Eligibility Criteria may be disqualified or removed by the Organizer from the Game without any prior notice.
• If the Participant is deemed to have undertaken fraudulent activities and/or other activities harmful to this Game, the Organizer, the entry process and/or the relevant website, the Organizer reserves the right to disqualify and remove the Participant from the Game without any prior notice.

Game Rules

• The Game is open to Participants in both online and offline method. The online Game will be held from 20 January 2023 until 26 February 2023 (hereafter referred to as “Game Period A”). The offline Game will be held from 24 February 2023 until 26 February 2023 (hereafter referred to as “Game Period B”).
• By participating in either the online or offline Game, Participants are deemed to have fully read, understood, and agreed to be bound by these Terms and Conditions, as may be amended from time to time.
• Each Participant can participate in the online Game during Game Period A through the following steps:
  • Launch the Game page and log in or sign up as a JAPAN by Japan member.
  • Click on the “Japan 47 Prefectures Game!” button to start the Game.
  • A randomly generated digital coupon with the redeemable prize(s) will be presented to the Participant at the end of the Game. Once the digital coupon is shown on screen, it is considered one successful redemption.
  • Participant is to bring along the digital coupon to the Redemption Venue to redeem the prize(s).
• Each participant can participate in the offline Game during Game Period B through the following steps:
  • Visit Suntec City North Atrium or West Atrium during Game Period B from 10am to 10pm.
  • Approach Game corner and enter the Game.
  • A randomly generated digital coupon with the redeemable prize(s) will be presented to the Participant at the end of the Game.
  • Participant will proceed to redeem his/her prize(s) at the Redemption Venue.
• Digital coupons are deemed void and no redemption will be permitted if the Organizer determines, at its absolute discretion, that the coupon is not original, is illegible, incomplete, altered, counterfeit, produced in error or obtained through fraud or theft or has been duplicated.
• Number of digital coupons are limited and based on first come first served basis. The Game will end once the Game Period is over, or when all digital coupons are fully redeemed, whichever occurs first.
• The number of digital coupons is distributed in the following manner:
  • Online Game: 611 digital coupons
  • Offline Game: 517 digital coupons

  Manner of distribution and number of digital coupons are subject to change and Organizer reserves the right to amend or cancel at any time without prior notice.

• All decisions made by the Organizer in relation to the Game, the digital coupons and other related matters are final. The Organizer will not enter into any correspondence regarding the decisions or results.
• The Organizer reserves the right to pursue legal action against any individual and any Participant whom the Organizer believes to have undertaken fraudulent activities and/or other activities harmful to this Game, the Organizer, the entry process and/or the relevant website.
• Participants undertake that they shall not seek to recover and shall not be entitled to recover from the Organizer or to be indemnified by the Organizer against, any direct, indirect or consequential loss, damage, costs, fees or expenses howsoever sustained, incurred or paid by the Participant as a consequence of participation in this Game. In no event shall the Participant seek to join the Organizer as a party, or otherwise make the Organizer a party, to any such claims, actions or proceedings.
• If for any reason this Game is not capable of running as planned due to computer viruses, bugs, worms (malware), trojan horses, denial of service attacks, hacking, tampering, unauthorized intervention, fraud, technical failures, or any other cause beyond the control of the Organizer that corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Game, the Organizer reserves the right, at its sole discretion, to disqualify any individual and any Participant who tampers with the participating process, and/or cancel, terminate, modify, or suspend this Game.

Selection and Judging Criteria

• Digital coupons for prize(s) are randomly generated and presented to Participants.

Prize(s)

• Participants will be presented with a digital coupon at the end of the Game. Prize(s) include sake sampling or exclusive goods from Japan and are presented randomly to Participants.
• Each Participant must present verifiable identification to redeem his/her Prize. The Organizer reserves the right to disqualify the winners who fail to comply.
• Each Participant of the online Game is limited to only one participation per JAPAN by Japan account. All Prizes are non-transferable, non-exchangeable and non-refundable by cash.
• Where the prizes redeemed are alcoholic, it is the Participant’s sole responsibility to ensure that there is no unlawful consumption of alcohol (i.e., underage alcohol consumption). Verification of age will be conducted at the time of exchange and Participants will be required to present a valid government-issued photo ID.

Use of Personal Information

• Any collection, use, and disclosure of the Participants’ data will be strictly in accordance with the Organizer’s Privacy Policy which can be found at http://japanbyjapan.com/privacy-policy. By agreeing to participate in this Game, Participants signify that they have fully read, understood, and agreed to be bound by these Terms and Conditions, the Organizer’s conditions of use on the website, and the Organizer’s Privacy Policy.

Disclaimer

• The Organizer excludes, to the extent permissible by law, all conditions and warranties implied by custom, the general law or statute. The Organizer further excludes, to the extent permissible by law, all liability to the Participant or any third party for any losses or damage, whether direct, indirect, incidental, consequential or otherwise, or any costs, fees or expenses, arising out of or in connection with their participation in this Game, including without limitation loss of profits, and damages arising from personal injuries (including death), even if the Organizer has been advised of the possibility of such loss or damage.
• The Organizer is not liable for network connection expenses caused by system errors or failures in the Game website. Participants will shoulder any fees incurred during participation (i.e., internet connection).

Miscellaneous

• All rights and obligations of the Organizer and the Participant are governed by the laws applicable in Singapore and each of them submit to the jurisdiction of the Courts of Singapore.
• Any dispute arising out of or in connection with these Terms and Conditions, including any question regarding its existence, validity or termination (“Dispute”), shall be settled by mediation in Singapore by the Law Society of Singapore (“LawSoc”) in accordance with LawSoc’s Mediation Procedure in force for the time being. Unless otherwise agreed by the parties, the mediator(s) will be appointed by LawSoc. The mediation will take place in Singapore in the English language and the parties agree to be bound by any settlement agreement reached.
• If the mediation does not result in a settlement agreement within four (4) weeks of the date of the first request for mediation made by either party, the Dispute shall be referred to and finally resolved by arbitration administered by LawSoc in accordance with its Arbitration Rules (“LawSoc Arbitration Rules”) for the time being in force, which rules are deemed to be incorporated by reference to this clause. The seat and venue of the arbitration shall be Singapore. The tribunal shall consist of one (1) arbitrator. The language of arbitration shall be English. The arbitration agreement contained in this clause shall be governed by the laws of Singapore.
• All communications required to be given must be sent to the address of the recipient (including email addresses) or by such other means as the Organizer may specify.
• The parties agree that any illegal or unenforceable provision will be severed from these Terms and Conditions and will not affect the continued operation of the remaining provisions; and to use their best endeavours to replace any severed provision with a provision having a commercial import as close as possible to the severed provision.
• These Terms and Conditions constitute the entire agreement between the parties as to the Game and supersedes all prior representations and agreements in connection with that subject matter.
• Except as specifically provided hereunder, a person who is not a party to these Terms and Conditions shall have no right under the Contracts (Rights of Third Parties) Act.
• Nothing in these Terms and Conditions shall constitute any party as the agent of the other parties, or create a partnership, joint venture or similar relationship between the parties, and no party shall have the power to obligate or bind the other parties in any manner whatsoever.
